4. Data Processing regarding the LMS and Tutoring Registration on this Website

You can register on our website to use additional functions on the site, specifically the Learning Management System. We use the data entered only for the purpose of using the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will reject the registration.

Online Conferencing Tools For live tutoring sessions, we use video conferencing tools (e.g., Zoom, Microsoft Teams, Google Meet). If you communicate with us via video or audio conference via the Internet, your personal data will be collected and processed by us and the provider of the respective conference system.

1. Scope of Application

These General Terms and Conditions (hereinafter “Terms”) govern the contractual relationship between Your German Way (hereinafter “Tutor”) and the client (hereinafter “Student”). These Terms apply to all language tuition, coaching, and related services provided by the Tutor via www.yourgermanway.de or other agreed channels.

2. Services Provided

2.1 Language Instruction: The Tutor provides German language lessons (online or in-person) tailored to the Student’s proficiency level and goals. 2.2 No Guarantee of Results: The Tutor commits to providing high-quality instruction and preparation. However, language acquisition depends on the Student’s individual effort and practice. Therefore, the Tutor does not guarantee specific exam results (e.g., Goethe, TELC) or fluency levels.

3. Booking and Contract Conclusion

Booking: Appointments are booked via the website booking system or by mutual written agreement (email/messaging).

Contract Formation: A binding contract is formed once the Tutor confirms the appointment and the Student completes the payment or possesses a valid credit balance.

4. Payment Terms

Rates: The current rates are listed on www.yourgermanway.de. All prices are final.

Timing:

Single Lessons: Must be paid in full at least 24 hours prior to the start of the lesson.
Packages: Lesson packages must be paid in advance in full.
Validity of Packages: Prepaid lesson packages are valid for 6 months from the date of purchase. Unused credits expire after this period and are non-refundable.

5. Cancellation and Rescheduling Policy

To ensure efficient scheduling for all students, the following strict cancellation policy applies:

More than 24 Hours Notice: If the Student cancels or reschedules a lesson more than 24 hours before the start time, there is no fee. The lesson credit is retained.
Less than 24 Hours Notice: Cancellations made within 24 hours of the start time will be charged at 100% of the lesson fee. If using a package, one credit will be deducted.
No-Show: If the Student does not join the lesson within 15 minutes of the scheduled start time, it is considered a “No-Show.” The lesson is forfeited, and no refund or reschedule will be offered.
Tutor Cancellation: If the Tutor must cancel, the lesson will be rescheduled or refunded in full.

6. Technical Requirements (Online Lessons)

Responsibility: The Student is responsible for providing a functional internet connection, headset, and webcam.

Disruptions: Lessons that cannot take place or are shortened due to technical issues on the Student’s side are charged in full.

7. Intellectual Property

Materials: All teaching materials provided by the Tutor (PDFs, worksheets, slides) remain the intellectual property of the Tutor.

Usage: The Student receives a non-exclusive right to use these materials for personal study only. Sharing, selling, or publishing these materials is strictly prohibited.

8. Liability

The Tutor is liable for damages caused by intent or gross negligence.

The Tutor assumes no liability for technical disruptions of third-party platforms (e.g., Zoom, Skype, Google Meet) that are outside the Tutor’s control.

9. Data Protection

Personal data provided by the Student will be processed exclusively for the purpose of contract fulfillment and lesson preparation, in compliance with the GDPR (DSGVO). Data is not shared with third parties without consent.

10. Applicable Law and Jurisdiction

Governing Law: This contract is governed by the laws of the Federal Republic of Germany and Kenya

Jurisdiction: The place of jurisdiction for all disputes arising from this contract is Kisumu.
